If you choose to ignore the complaint and do not respond within 20 days the Credit Card Company will get what is
called a Default Judgment against you. Since you did not respond they automatically get a judgment against you and
they will typically get the full amount they sought in their lawsuit plus attorney’s fees, plus court costs, and post
judgment interest against you. And, in certain cases they can garnish your wages, bank accounts and other assets
to recoup what they are owed in the judgment.
Should you decide to respond yourself, you do not want to write a letter to the Credit Card Company’s attorney and
admit anything, as it will be used against you. What you should do is get on the Internet and start researching how to
respond to a lawsuit. You’ll be acting as your own lawyer so you need to make sure you do things right or you will
cause yourself more problems than you started with. It’s important that you do your research, educate yourself and
respond as best you can.
If you decide to hire an attorney, an attorney will help you deal with your Credit Card Company and their lawyer and the
Judge without you having to worry about it because that is the attorney’s job.
No matter what the situation is, there is usually a defense that can be raised that will provide you with leverage to
either resolve the situation in a way that is more beneficial to you than getting a default judgment or to outright win
your case. The overall goal is a resolution that you and the credit card company can agree to and live with. If
